1 Appellants, Jenetta Marie Ware and Peggy Gwendolyn Smith, hereinafter referred to as defendants, were charged in the District Court, Oklahoma County, Case No. CRF-74-4332, with the offense of Larceny of Merchandise from a Retailer, After Former Conviction of a Felony, in violation of 21 O.S. 1971 § 1731 [21-1731]. They were tried by a jury and convicted of the aforementioned crime. Their punishment was fixed by the jury at ten (10) years in the State Penitentiary in accordance with 21 O.S. 1971 § 51 [21-51]. From said judgments and sentences, a timely appeal has been perfected to this Court.
